Eligibility to Begin the Work Permit (EAD) Process
Generally, to be eligible for an Employment Authorization Document (EAD), you must fall into one of the following categories:
1. Asylum Seekers and Refugees
Asylum applicants (after 150 days of pending application)
Granted asylum or refugee status
2. Adjustment of Status Applicants
Pending green card applications
3. Specific Visa Holders
F-1 students eligible for Optional Practical Training (OPT)
J-1 exchange visitors with specific circumstances
Spouses of E-1, E-2, E-3, or L-1 visa holders
4. Humanitarian Cases
Temporary Protected Status (TPS) recipients
Deferred Action for Childhood Arrivals (DACA) recipients
U or T visa holders (victims of crimes or trafficking)
